1. Introduction

Welcome to Lunax Décor ("Company", "we", "our", "us"). These Terms of Service ("Terms") govern your use of our website, event decoration, planning, and rental services. By accessing our website or using our services, you agree to be bound by these Terms. If you do not agree, please do not use our services.

These Terms incorporate our Privacy Policy. We recommend reviewing both documents before proceeding.

2. Services

We provide event decoration, planning, and rental services as described on our website. Services include custom decor setups, venue styling, and equipment rentals for weddings, corporate events, birthdays, and more. All services are subject to availability, venue approval, and our acceptance of your booking. We reserve the right to refuse or cancel service for any reason, including safety concerns or non-compliance with venue policies.

For rentals, items are provided for temporary use only and must be returned in the same condition. Delivery, setup, and teardown are available at additional cost, subject to our schedule.

3. Booking and Payments

To secure services, a signed contract and non-refundable deposit (typically 50% of the total quote) are required. The balance is due 14 days before the event or as specified in the contract. We accept payments via credit card, e-transfer, or invoice methods outlined in your quote.

Late payments incur a 1.5% monthly fee. All prices are in CAD and subject to applicable taxes.

4. Cancellations and Refunds

Deposits are non-refundable. Cancellations more than 30 days before the event may receive a 50% refund of the balance paid. Cancellations within 30 days forfeit all payments. We may cancel due to unforeseen circumstances (e.g., weather, force majeure), providing a full refund or rescheduling option.

Clients are responsible for notifying us promptly. Refund processing takes 5-7 business days.

5. Rental Agreement

All rental items remain our property. Clients assume responsibility from delivery to pickup. Damage, loss, or theft will be charged at full replacement value plus labor fees. Items must not be modified or used outdoors without prior approval. A damage waiver is available for an additional 10% fee.

6. Client Responsibilities

Clients must provide safe venue access for setup (allow 3 hours) and teardown. Ensure venue permits our decorations and complies with local regulations. We are not liable for venue restrictions, damages from client modifications, or third-party interference. Provide accurate event details (guest count, timeline) to avoid surcharges.

7. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for indirect, incidental, or consequential damages, including lost profits or data, arising from our services. Our total liability shall not exceed the amount paid by you. This includes risks like allergic reactions, equipment failure, or event disruptions beyond our control.

8. Intellectual Property

All designs, photos, and content are our intellectual property. Clients receive a limited license for personal event use. Commercial reproduction requires written permission. Photos taken by us may be used in our portfolio unless opted out in writing.

9. Governing Law

These Terms are governed by the laws of Alberta, Canada. Any disputes shall be resolved in Alberta courts. Both parties agree to attempt mediation before litigation.

10. Force Majeure

We are not liable for delays or failures due to acts of God, strikes, or other events beyond our control. In such cases, we will work to reschedule or refund proportionally.

11. Changes to Terms

We may update these Terms at any time. Changes will be posted here with the new effective date. Continued use constitutes acceptance.
